Welcome to nvpixx (“we,” “us,” “our”). These Terms & Conditions (“Terms”) govern your use of our website https://nvpix.ca and any photography or videography services you book with us. By accessing our site or booking a session, you agree to these Terms.

1. DEFINITIONS

  • Client: Any person or entity that books or purchases nvpixx services.
  • Services: Photography and/or videography sessions, digital files, prints, albums, or other deliverables provided by nvpixx.
  • Agreement: The contract between Client and nvpixx, comprised of these Terms plus any service-specific proposal or invoice.

2. BOOKING & PAYMENT

  1. Quote & Deposit: A non-refundable deposit of 25% of the total fee is required to secure a session date.
  2. Balance Due: The remaining balance is payable no later than 7 days before the session (or upon delivery of final images, if later).
  3. Accepted Methods: Credit/debit card, bank transfer or PayPal. Refer to your invoice for details.

3. CANCELLATION & RESCHEDULING

  1. By Client:
    • More than 14 days before session: Transfer deposit to new date with no penalty.
    • 7–14 days before session: 50% of total fee due.
    • Less than 7 days: Full fee due.
  2. By nvpixx: We reserve the right to cancel or reschedule due to illness, equipment failure, or force majeure. In such cases, you may choose an alternative date or receive a full refund of any fees paid.

4. DELIVERY & TURNAROUND

  • Digital Files: Delivered via secure online gallery within 14 business days of the session.
  • Prints/Albums: Delivery time as specified in your order confirmation.
  • Revisions: Minor color or crop adjustments are free; major edits may incur additional fees.

5. USAGE RIGHTS & COPYRIGHT

  • Copyright: All images and videos created by nvpixx remain our intellectual property.
  • Client License: We grant you a non-exclusive, personal license to use, share, and print your images for personal (or agreed commercial) purposes. You may not resell or redistribute the files.
  • Promotional Use: We reserve the right to use any images or footage for our portfolio, marketing, social media, or website, unless you specify in writing that certain images be withheld.

6. LIMITATION OF LIABILITY

In no event shall nvpixx be liable for indirect, incidental, or consequential damages. Our total liability for any claim arising out of this Agreement shall not exceed the total fees you paid for the Services in question.

7. FORCE MAJEURE

Neither party shall be held liable for failure to perform due to causes beyond its reasonable control, including but not limited to natural disasters, acts of God, war, or government restrictions.

8. PRIVACY & DATA PROTECTION

Your privacy is important. Please refer to our Privacy Policy for details on how we collect, use, and protect your personal data.

9. GOVERNING LAW

This Agreement is governed by the laws of the Province of Alberta, Canada. Any disputes arising hereunder shall be resolved in the courts of Edmonton, Alberta.

10. AMENDMENTS

We may revise these Terms from time to time. The “Effective Date” at the top will reflect the latest update. Continued use of our website or services after changes implies acceptance of the new Terms.
